Domestic Violence Restraining Order Documents
A Domestic Violence Restraining Order (DVRO) is available to people who have experienced abuse, threats, harassment, or stalking by someone they have had a close personal relationship with. This includes current or former spouses, domestic partners, dating partners, and certain close family members.
The DVRO process in California begins with filing a petition that describes what happened and what protections you are requesting. If the court finds sufficient reason, a temporary emergency order can be issued the same day, before the other party is notified. A full hearing is then scheduled where both parties may appear.

A Civil Harassment Restraining Order (CHRO) is used when the harassment or threats come from someone who is not a close family member or intimate partner. Common situations include neighbors, coworkers, acquaintances, or strangers who are engaging in repeated harassment, stalking, or threatening behavior.
To qualify for a civil harassment restraining order in California, the conduct must involve harassment that is unlawful violence, a credible threat of violence, or a pattern of conduct that seriously alarms or annoys the petitioner with no legitimate purpose. The petitioner must show substantial emotional distress.

Workplace Violence Restraining Order Documents

This type of restraining order is filed using the WV-100 series of forms. It can prohibit the restrained person from coming to the workplace, contacting the employee, or engaging in further threatening conduct. A temporary order can be issued before a hearing if there is sufficient basis for immediate protection.
