Documents a change to the terms of an existing private promissory note, such as an interest rate adjustment or extended repayment period.
Seller-Financed Transaction Documents
Seller financing is a purchase arrangement where the seller agrees to carry all or part of the purchase price rather than requiring the buyer to obtain a traditional bank loan. These transactions require carefully prepared documents to record the agreed terms and protect both parties.
Common seller-financed structures include straight seller carryback notes secured by a deed of trust, all-inclusive deeds of trust that wrap an existing mortgage, land contracts where title transfers on final payment, and lease-purchase arrangements that combine a rental period with an obligation to buy.

Private and hard money lenders who make loans secured by California real estate need a promissory note and a deed of trust to properly document and record each loan. The promissory note sets out the loan terms agreed upon between the parties, and the deed of trust is recorded with the county to establish the lender's security interest in the property.
We prepare promissory notes and deeds of trust for private party loans based on the loan amount, interest rate, repayment terms, and property information you provide. When a private loan is paid off, we also prepare the reconveyance deed that releases the lien from the property's title.

Deeds of trust and certain other instruments must be recorded with the county recorder's office to be effective against third parties. We prepare the documents - recording is completed by you or your escrow or we can help with ficilitation.
